The article 17 of the technical Regulation foresees that in case the accident at work has been an inexcusable mistake of the boss, the CASS it will be able to demand the totality or part of the expenses that has endured the above mentioned accident. To this end, the CASS will perceive a supplementary quote calculated of agreement with the personal quote of the boss.
This quote will be able to be perceived only during a maximum term of two years and in ningun case will not be able to bring management part of the wage earner or the personal quote of the boss to an amount to the double of the normal quote.
There is understood by inexcusable mistake that mistake committed by the boss without intention of harming, for recklessness or negligence, without bearing in mind the elementary rules of safety foreseen in the regulation decreed by the M.I. General Council.
